OSHA Needs to Obtain a Warrant in Order to Interview Casino Workers

On April 28, 2007, an inspector from OSHA was able to inspect the Casino del Sol, one of the two casino facilities that are owned and managed by the Pasqua Yaqui Tribe, last January with a search warrant.

However, the search warrant did not include anything that would allow the OSHA Inspector to speak to the employees regarding their everyday work, especially the precautions that they are taking. Tribal Officials from the Pascua Yaqui prevented the OSHA Inspector from talking to the workers, saying that he was abusing the power of the search warrant.

OSHA also asked if they could check out the Casino of the Sun, which is the tribe's other casino gambling facility, but tribal officials refused because the search warrant did not permit it.

OSHA then asked U.S. District Judge Frank Zapata to hold Casino Del Sol and the Pasqua Yaqui Indian Nation in contempt of court. Nonetheless, Judge Zapata sided with the Pasqua Yaqui Tribe.

OSHA could get another chance to question the casino workers about their safety practices if they obtained another search warrant.

According to official records, Casino Del Sol, which opened in 2001 and currently employs around 1,400 employees, has never been investigated by OSHA.
